The Eve of Arizona’s SB1070: The Eve of Destruction?

Flag of Arizona  On the eve of implementation of SB1070, Arizona’s anti-illegal immigration law, United States District Court Judge Susan Bolton, a Clinton appointee, issued her decision on the federal government’s suit seeking an injunction against or the voiding of SB1070.

In a nutshell, illegal aliens won, the American people lost, although we haven’t lost everything.  The judge gutted the principal features of the law but allowed some provisions to stand. 

Also, there will be appeals, first to Bolton to re-consider her decision and then probably to the Ninth Circuit Court of Appeals which is the most liberal circuit court in the country but which has sided with Arizona on similar issues in the past. 

There were high hopes that Judge Bolton would find for Arizona since she had voiced skepticism as to whether SB1070 actually does pre-empt federal immigration law and whether the feds should be trying to overturn Arizona’s right to be “inhospitable” to illegal aliens but politics eventually prevailed.

Okay, so what’s out and what’s still in?

for Judge Susan Bolton to  What’s Out:  Law enforcement officers may not ask suspected illegals for immigration papers or require them to provide documentation nor can they detain suspected illegals.  The state may not criminalize illegals securing work.  Without a warrant, the police may not arrest anyone suspected of committing a deportable offense. 

What’s Still In:  It’s still will be illegal for a vehicle to stop to hire day laborers and to transport undocumented aliens.  Arizonans may still “file suit against any agency, official, city or county for adopting policies that restrict the ability of workers to enforce federal immigration law ‘to less than the full extent permitted by federal law:’ ” http://tiny.cc/k27×1 

In addition to those of us who believe in borders, some other people are bound to be upset over the ruling.

For one, proud homosexual rock star, Elton John, had already jumped into the fray denouncing fellow artists who are boycotting the state of Arizona.  “We are all very pleased to be playing in Arizona,” he recently said, adding, ”I have read that some of the artists won’t come here. They are f***wits! Let’s face it: I still play in California, and as a gay man I have no legal rights whatsoever. So what’s the (expletive) with these people?” (http://tiny.cc/ensf6)

Another, the irrepressible Sheriff of Arizona’s Maricopa County, Joe Arpaio, will be disappointed.  He had announced that he’s “not going to put up with any civil disobedience” as a result of the law.  He was prepared to lock up in his Spartan tent jail any protestors who broke the law as well as any illegals he caught: http://tiny.cc/l4b4n

In order to facilitate the safe, orderly passage of illegals back to Mexico, Americans for Legal Immigration PAC, ALIPAC, had urged the feds to establish “border checkpoints along the U.S. border for illegal immigrants so they can leave without fear of being detained or prosecuted for immigration crimes.” 

ALIPAC had an ulterior motive aside from making things easy for the illegals, namely to show that ”Comprehensive immigration enforcement works and has the desired effect without mass deportations:” http://tiny.cc/lsqbh  

That makes sense and undercuts the federal argument that the mass deportation of 11 million illegals in the United States was not feasible.  It also would have negated any plans of Obama and Company to grant them a general amnesty–and citizenship–so that they can register and vote for Democrats.

Finally, Judge Bolton’s decision has ramifications that go far beyond Arizona.

In a sign that highlights the entire matter of illegal immigration as well as the temerity of the Mexican government in the face of weak-kneed law enforcement by Obama’s DHS and DOJ, the Mexican Consulate announced plans to dispatch “personnel” to New York’s Staten Island due to recent attacks on immigrants in that borough: http://tiny.cc/fhg5t

Riddled with crime with its citizenry fleeing like rats from a sinking ship, Mexico, a Third World, third rate poor excuse for a country, is showing it has so little respect for los Estados Unidos that it would presume to supervise our law enforcement!   

Also, what will now be done about so-called “sanctuary cities,” such as San Francisco, which flout federal law to provide refuge for illegal aliens?

The Obama administration has seen fit to take a sovereign state to court for attempting to do what the federal government refuses to do, that is, to enforce existing immigration statutes but allows sanctuary cities to break those laws with impunity. 

There is something egregiously wrong with that picture which directly relates to the crux of the illegal immigrant issue. 

When a nation fails to enforce its own statutes and ignores municipalities or anyone else who violate those statutes, it effectively declares the rule of law no longer exists.  The result could ultimately be national chaos. 

Judge Bolton has just made that scenario a probability rather than a possibility. U.S. District Judge Susan

    The original 1070 had a provision that being in Arizona illegally is a state criminal offense. Also E-verify is required for employment. These two were not struck down by the federal judge. Thus Arizona should be able to enforce these two portions of the law.
    We note that the liberal media keep saying that it is not possible to get 11-million illegals departed. But one-half million have left Arizona as a result of the original law. This self-deportation does work. With no employment and the risk of imprisionment, the 11-million will leave. If they stay and become legal, they will bring in families and the total
    might reach 60-million.
