There are 18 states that allow for recall of their senators and congressmen those states are Alaska, Arizona, California, Colorado, Georgia, Idaho, Kansas, Louisiana, Michigan, Minnesota, Montana, Nevada, New Jersey, North Dakota, Oregon, Rhode Island, Washington and Wisconsin. I would have to assume all other states would have to have a ballot initiative sponsored before they could do the same which would take entirely too long. The senators and congressmen could be recalled on the basis of malfeasance, which means the performance by a public official of an act that is legally unjustified, harmful, or contrary to law; wrongdoing (used esp. of an act in violation of a public trust). If voting for a bill or bill’s that are not constitutional is not malfeasance I am not altogether sure what would be.

There are steps that must be taken in order to institute a recall and those are as follows: Determine the grounds for recall. You’ll need this information to make your case to the population but in 7 of the 18 states specific grounds are actually required. In these states, if your reasons don’t measure up, you won’t be allowed to proceed with the recall. Get signatures. You’ll need a petition to get a recall election. The number of signatures is usually a percentage of the voters at the last election but this differs by state. Prepare for a response. At some point during the process, the senator will be notified that a petition for recall is being circulated. She will then have a chance to respond to the allegations. Get voters to the recall election. Once the recall election is granted, alert the community and get them out to vote. The ballot will ask whether or not the senator should be recalled and the state may hold an election at the same time to elect the next person for that office. A website or phone campaigns are good ways to get your petition going. Going door-to-door is also an option although it is more time consuming than the other two. This is important since you only have a set number of days to obtain the correct number of signatures—anywhere from 30 to 180 days. You will be fighting an uphill battle to recall a U.S. Senator. No member of Congress has ever been recalled in the history of the United States.

Sadly we have come to a point in our country where every day American citizens have to search for ways to make sure the voice of the people is heeded. A government for the people, by the people is no more, people whose only concern this week should be getting ready for Thanksgiving are scared to death there will be nothing left this time next year. All the while we have senators and congress people sneering at us daily telling us what we will get whether we want it or not. There is something to be said for making their Thanksgiving miserable as hell, but no one could be blamed if they wanted just for this week to forget it all and enjoy their family and count their blessings. It has been a very tiring year, the people have fought valiantly and I am so very proud of what has been accomplished, still the fact remains that after Thanksgiving they will vote on the healthcare bill and if they cannot get enough votes the normal way they will attach it to the defense bill and it will be passed because no senator or congressman wants to be known as the one who did not vote to fund the troops. Once the bill is finally passed we as citizens can sue for a Bill of attainder, a Bill of attainder, is an act of the legislature declaring a person or group of persons guilty of some crime and punishing them without benefit of a trial. Which is what the healthcare bill attempts to do. So this is far from over, the American people will decide when this is over.
