Blagojevich appointment of Burris called constitutional

A legal scholar and former member of the Federal Election Commission is questioning the constitutionality of Senate Democrats’ plan to block Illinois Governor Rod Blagojevich’s appointment of former Illinois Attorney General Roland Burris to fill Barack Obama’s vacant Senate seat.

Senate Democrats, with the backing of president-elect Barack Obama, have staked out their ground and declared that they will not seat anyone appointed by the scandal-ridden Illinois governor, who was arrested last month after allegedly trying to “sell” the vacated Senate seat in exchange for campaign contributions.
