Second Amendment Upheld!

It should be no surprise that Justices Breyer, Souter, Stevens and Ginsberg dissented when it comes to the issue of the second amendment and the right of the people to keep and bear arms for their own self defense. The fact that something is clearly written in the Constitution and that there are myriads of quotes from the founding fathers that support such a right has never meant much to liberals who think they are smarter, that they are better and that they should be the ones to mandate what should and should not be.

The case in question (District of Columbia v. Heller) involves an obscene restriction on the ownership (keeping) and use (bearing) of arms in Washington DC despite the clear words that say such “shall not be infringed” by Congress, states or local governments (see amendment 14 to the Constitution if you do not understand this).

The question the Supreme Court answered was, if “provisions [passed by the District of Coulumbia] violate the Second Amendment rights of individuals who are not affiliated with any state-regulated militia, but who wish to keep handguns and other firearms for private use in their homes.” Now, the literal ban on the second amendment has been lifted by this ruling of the Supreme Court which did something good despite earlier in the week rewriting the Constitution to find a phantom limitation on when the death penalty can and cannot be used as punishment.

The fact that the Supreme Court is this schizophrenic in issuing decisions, at one time trashing the Constitution while in the next moment upholding it, is a deep cause for concern heading into the upcoming Presidential elections.

I personally have no faith in either major candidate (or even any minor ones for that matter) being able to bring this court back to its Constitutional roots and authority on a regular basis by appointing Justices who will uphold the Constitution when filling vacancies which surely will occur during the next couple years.

Despite John McCain’s promises to do so I cannot trust a man that brought forth McCain-Feingold and violated the first amendment himself. And God will be our only hope if Barack Obama gets elected and brings us more Souters, Breyers, Kennedys, Stevens and Ginbergs.
