Judge Oversteps Authority – Creates Fallacy To Strike Down Law

Never doubt the tenacity of liberal, activist judges when it comes to their own political agendas. They are more than willing to create lies and then base the reasoning for their ruling on those lies.

FARMERS BRANCH, Texas (AP) — A Dallas suburb’s ban on apartment rentals to illegal immigrants, an ordinance passed by city leaders and later endorsed in a vote by its residents, is unconstitutional, a federal judge found Wednesday.

Only the federal government can regulate immigration, U.S. District Judge Sam A. Lindsay concluded in his decision.

The city didn’t defer to the federal government on the matter, violating the supremacy clause of the U.S. Constitution, which allows for the federal government to pre-empt local laws, Lindsay said

Only one (big) problem with the reasoning – the law did not regulate immigration! The law only said that if one is in fact in violation of federal immigration law that it was illegal to rent to them in the municipality.

The exact wording of the clause in question is:

“The Migration or Importation of such Persons as any of the States now existing shall think proper to admit, shall not be prohibited by the Congress prior to the Year one thousand eight hundred and eight, but a Tax or duty may be imposed on such Importation, not exceeding ten dollars for each Person.” – Article I, Section 9

This law does not dictate who can and cannot “migrate” or be “imported” into the United States. Thus there is no conflict with the supremacy of the United States Congress when it comes to setting who is and who is not in the country illegally.

Sorry Mr. Lindsay but you deserve an nice impeachment for overstepping your bounds and also revocation of your federal pension as well. And if not for that, then for just being too damn illiterate to serve the people effectively.
