Musician’s immigration status at issue in Clinton fundraising concert

First she adopted Canadian Celine Dion’s “You and I” as her official campaign song; now, Hillary Rodham Clinton has tapped Sir Elton John for a fundraising concert April 9 at Radio City Music Hall in New York City.
But whether Sir Elton, a British citizen, can legally play a concert to raise funds for an American presidential candidate remained unclear Thursday. He previously performed at fundraisers in 2000 for Al Gore’s presidential campaign and Clinton’s Senate bid.

“The Clinton campaign is confident the concert is legal,” said spokesman Blake Zeff.

According to federal election law, foreign nationals are prohibited from making “any contribution of money or other thing of value” to local, state or federal office elections.

However, the term contribution does not include the “value of services” provided for free by a volunteer for a political committee or candidate, according to the Federal Election Commission.

The question of legality may be moot if Sir Elton is a permanent resident in the United States. He’s retained British citizenship but lives part-time in Atlanta. Permanent residents are not subject to the prohibition on contributions.

Sir Elton’s immigration status could not be determined. The Clinton campaign referred that question to John’s publicists, who were not available for comment after multiple requests.
