Wanna-be Soldiers Find No Asylum in Canada

J.J. Jackson* | November 23, 2007

OTTAWA — Canada’s top court will not hear the case of two Americans who sought refugee status here after deserting the U.S. army in 2004 to avoid being deployed to Iraq.In a decision released Thursday, the Supreme Court of Canada rejected a bid by Jeremy Hinzman and Brandon Hughey to stay in Canada as refugees. The court’s ruling backs previous ones by the Federal Court, the Federal Court of Appeal and the Immigration and Refugee Board.

Before Thursday’s ruling, the Federal Court of Appeal last rejected the claims by Hinzman and Hughey, who crossed the border rather than face possible court martial and imprisonment for refusing to serve in a war they say they morally oppose and is illegal because it was not sanctioned by the United Nations.

The two men have also argued they face persecution in their home country because of their political opinion. You’ve got to feel sorry for these yummy brains that join the army and then think that they have a choice as to which wars they fight in. Doesn’t work that way. Now come home so we can take care of you … properly.

Next time, before joining a cause, make sure that you understand the commitment you are getting into. The military is not a “if you feel like it” organization. You follow orders or you get your butt thrown in prison. This ain’t a game. You don’t “play” soldier when you put on the uniform; you ARE a soldier.

Well perhaps they were illed informed about the military. After all most are kids when they sign for service and many do so in an effort to scape their economical status at the time. The war is a romantic thought at that point such as “Fighting to defend your country” “fighting for freedom”. Yet unfortunately one doesn’t know whether he is fit for the realities of the service until having served in a military conflict. Many soldiers after one tour there refure to return. The thoughts of war are more real. They witness attrocities they have never realized were part of military warfare. I wonder how many never thought they would have had to be engaged in conflicts that killed many civilians including children.
Maybe soldiers should join for a probationary period and if they don’t like it they could leave. Leave in service only the ones who think they can handle the stresses of military life.

I will not mince words. As a vet I am offended that you would even make this statement: “After all most are kids when they sign for service and many do so in an effort to scape their economical status at the time.”

The modern American soldier on average is one of the most educated members of society, come from families of means and do not grow up in some dire situation that requires them to “escape” from some “economic status”.

Like Jeff said, the military is not an ‘if you feel like it organization’ and this is made abundantly clear when you sign up.

We need to stop making excuses for people that act like they can join the military, get their “free” money for tuition/signing bonus/etc. and then jump ship at the first sign of having to be deployed.

    OOHRAH Ron.

I’m inclined to agree with you and Jeff.

However I would be willing to accept, as USGLORY said, “soldiers should join for a probationary period and if they don’t like it they could leave.”

I’d agree to that ONLY IF when they decided that the military simply isn’t for them that they return every dime of tax payer money given to them (salaries, tuition, signing bonus) plus interest. No reason to pay them for services not rendered!
