I Hear More Goose-Stepping

GOLDEN, Colo. — A judge has upheld a homeowners association’s order barring a couple from smoking in the town house they own.

Colleen and Rodger Sauve, both smokers, filed a lawsuit in March after their condominium association amended its bylaws last December to prohibit smoking.

“We argued that the HOA was not being reasonable in restricting smoking in our own unit, nowhere on the premises, not in the parking lot or on our patio,” Colleen Sauve said.

I’ve said it before and I’ll say it again, these homeowners associations are magnets for power hungry little socialists.

They are “governments” subservient to the Constitution and as such they are prohibited by the Constitution (Amendment 14) from infringing upon the rights and privileges of citizens as the Constitution enumerates. And unless I am mistaken, private property is a right that has been respected in this country for years.

The problem is apparently (best as I can tell) that the buildings allow the smoke smell from one town house to migrate to another because of poorly designed ventilation systems. I make this assumption based on the information that they are allowed to smoke outside all they want! So it must be something internal.

This is a problem that the homeowners association should address by FIXING that problem. But no. Rather than spending money and actually doing something they punish other people instead.

Hey nothing new for liberals!

What’s next? If a person moves in who likes to cook spicy food and that odor causes someone else’s eyes to water are they going to tell them that they cannot eat the food they like? Where does it end?

I’ll never be caught dead living in one of these little enclaves. And if I ever do against my will there will be bullets flying if anyone ever tries to come into my home which I own and stop me from doing legal things.
