People’s Republic of Philadelphia Infringes On Private Property Rights

This crap is getting ridiculous. Somewhere along the way we have lost and understanding as to what the basic rights of Americans are:

Philadelphia mayor OKs ban on smoking in restaurants, most bars

PHILADELPHIA - The mayor on Thursday signed into law a ban on smoking in restaurants and most bars.

Mayor John Street waited until the last possible moment to sign the bill after threatening a veto. He wanted a stronger law that would extend the ban to outdoor cafes, which are exempt.

“In the end the health concerns were the overriding issue that compelled me to sign the bill,” Street said.

Thirteen U.S. states and many towns and cities have banned smoking in bars, restaurants and other public places.

The Philadelphia law will exempt sidewalk cafes, tobacco stores, private clubs and so-called local taverns - places where drinks alone constitute at least 90 percent of gross sales. - Times Leader

It’s the same old, tired, Marxist argument of “We know what’s best for you and we’ll make it law”.

These establishments are PRIVATE PROPERTY. The state government does not have the authority to arbitrarily infringe on people partaking in legal activities in the privacy of their own home. And last time I looked cigarettes and tobacco were perfectly legal. And they will remain legal because government gets millions of dollars from taxes on the products and cannot wean themselves off that money.

Plus there really is no reason to make the products illegal. If people want to kill themselves by snarfing down a pack of smokes a day that’s their right. Another reason why “universal” health care is a bad idea. When enough people start dying and having to pay their own medical costs without the government to back them up or huge slush funds from court settlements (won only because the smokers themselves were stupid) from the tobacco companies to draw from, you will see smoking drop off.

Until then however we will have busybody politicians sticking their dicks where they don’t belong. In the end this is ultimately an Unconstitutional taking of private property for an invalid use.
