Texas Court to Reconsider DeLay Charge

Texas’ highest criminal appeals court agreed Wednesday to consider reinstating a conspiracy charge against former House Majority Leader Tom DeLay, a move that could delay his trial until next year.

DeLay is facing felony money laundering and conspiracy counts that stem from Republican fundraising in the 2002 legislative races. He stepped down as majority leader after the charges were filed and announced his resignation from Congress a few months later.

“It’s just another bump in the road,” DeLay attorney Dick DeGuerin said.

A state district judge threw out one of two conspiracy charges in December and let the money laundering charge stand. Prosecutors asked the appeals court to reinstate the dropped conspiracy charge, a move that has postponed trial proceedings on the other charges.

DeGuerin argues that the dropped charge accuses DeLay of conspiring to violate the election code as it stood in 2003, and that the transaction was legal at the time it was made. The second conspiracy charge accuses DeLay of conspiring to launder money.

Early on, DeLay had hoped to have the case resolved quickly so he could regain his leadership position in Congress. But with his resignation behind him, he is working on a book that he says will address how his career “furthered the conservative cause” and helped change the culture of Washington. - Forbes

Make no mistake. This is yet another attempt to continue dragging this case out as long as the prosecution can to aid politicos on the left. There is no reason this has not already gone to trial.

It either was a crime at the time or it was not. Get it over with and if DeLay is guilty put him in jail. However if this is nothing more than political shenanigans prosecutor Ronnie Earl should be tossed in the klink.
