No-knock Search Spin?
J.J. Jackson* | June 18, 2006
I came across this article by Gina Holland of the Associated Press and had a chuck at how she tries to be objective:
WASHINGTON - The Supreme Court made it easier Thursday for police to barge into homes and seize evidence without knocking or waiting, a sign of the court’s new conservatism with
Samuel Alito on board. - Yahoo
“Barge”? That is an interesting choice of words there Gina especially since the officers have a warrant. Sounds to me like what you really wanted to say was something like this:
“The Imperial Supreme Court made it easier Thursday for police to crash into the homes of citizens and seize evidence without knocking or waiting in an attempt to gather evidence to persecute them, a sign of the court’s new EVIL conservatism with Samuel Alito on board is leading to a fascist state.”
But that is just my take ;).
The whole “knock and announce” rule is extra constitutional in the first place and really doesn’t serve any purpose except as a courtesy to alleged criminals to possibly hide evidence.
Different types of searches should certainly take different tactics. There is probably little reason to break down the door of someone that is charged with a crime where no violence is involved. However to require officers to “knock and announce” when executing a valid warrant or else face the exclusion of evidence is ridiculous.
