First Amendment? What First Amendment?

Never underestimate the power of judges to simply ignore the Constitution when it suits them.

RIVERSIDE ? A judge allowed a lawsuit filed by the guardians of two suspected lesbians to proceed against a Christian school that expelled them, but the resolution of the case is likely months away.

No new hearings are scheduled in Mother Doe v. California Lutheran High School Association, except for a July 9 status conference. - Sign On San Diego

Question: What possible standing could the guardians have to even bring this case? In case you don’t know if one does not have standing there can be no case. What is their argument? “Your honor we demand that you tell a religious institution to accept our daughters even though it is against what they believe”? Uh - but doesn’t that violate the actual RIGHT of the church to be free from interference by the government? And since Congress (or the States for that matter according to Amendment XIV) cannot pass a law that prohibits the “free exercise” of religion what standing can they possibly have?

There can be no law that makes the act illegal and hence no case. I repeat, there can be NO law that makes such an act illegal because the Constitution says there can be no such law. Hence the argument that the state’s civil right laws take precedence is a fallacious argument.

Never confuse a liberal with the facts however. No wonder our courts are over burdened considering that judges can’t even make simple decisions based on simple facts.
