The RIGHT Approach For Eminent Domain

I’ve commented before on the attempt currently under way to take Justice David Souter’s Connecticut home via eminent domain since he apparently thinks increased tax revenue is a valid “public use” for taking the private land of others. A group of protestors is preparing to descend upon he town to rally support for the Lost Liberty Hotel which would replace the Souter home and bring in increased “taxes” and “revenue”.

Reports Fox News Bill Quigley, Weare deputy police chief on the protestors

“They’re obviously not going to be allowed on Justice Souter’s property,” he said. “There’s no reason for anybody to go down that road unless they live on that road, and we know the residents that live there.”

Gee, if only the government would take that some position we wouldn’t be in this predicament now would we?

That is what the policy should be on private property. “There’s no reason for anybody to go down that road unless they live on that road”.

But of course you have State Rep. Neal Kurk, a Weare resident, who said of the attempt

“Most people here see this as an act of revenge and an improper attack on the judicial system,” Kurk said. “You don’t go after a judge personally because you disagree with his judgments.”

Oh, give me a break! I’ll translate.

“How dare someone actually try and do to us bureaucrats and judges what we have said is good for everyone else! I’m outraged! OUTRAGED I tell you! We can take your land but how DARE you come after ours!”

Hey Mr. Kurk they are npt “going after” a judge for no reason. They are “going after” him because he failed to uphold the Constitution.
