The weakest plank of Ronnie Earl’s case against Rep. Tom Delay was thrown out of court today. The much talked about attempt by Mr. Earl to apply a 2003 law ex post facto to what Delay had done was never seen as a serious legal attempt (which begs the question as to why it was brought in the first place).

DeLay lawyer Dick DeGuerin argued that one of the charges ? conspiracy to violate the Texas election code ? did not even take effect until September 2003, a year after the alleged offenses occurred. Priest agreed and dismissed that charge.

Two other counts are still standing.
