What Should Happen If You Break An Unconstitutional Law?

The fallout from McCain-Feingold just wont seem to end. United States citizens are told how much they can give to political campaigns and when and few seem to care. Tom Noe a Republican Fundraiser in Ohio pleaded guilty Oct 31st to “illegally” trying to help get a message out and re-elect President Bush.
—Story in the Washington Times—
The question still sits and that needs to be answered is under what authority did Congress have to pass such egregious legislation in the first place? Anyone want to go through Article 1, Section 8 and find it for me?
Just like I have defended Democratic groups accused of violating Campaign Finance Reform, I continue to defend this witch hunt against Mr. Noe who was forced to plead guilty to a non-crime! (Hint: It’s a “non-crime” because Congress doesn’t have the authority to make it a crime even though they did)
The only answer to “campaign finance reform” has been and always will be FULL and COMPLETE disclosure by all parties involved so that everyone knows exactly how much money George Soros gives to the left and how much money people like myself give to the “right”.
End caps. End restrictions. “Free Speech” means “free speech” and that “shall make no law … abridging” it part means Congress cannot tell you “no” to your “free speech” just because an election is X days away.
