More Vacuous Rambling From The Moonbat Left

I love how Judge Alito’s nomination is bringing out moonbats spouting the same tired old hackery. Cragg Hines has a peice in the Houston Chronicle so full of intellectual dishonesty that it makes me want to stand up and ask for federal funding to get this loon his own TV show so that he can expose himself to the masses on a daily basis!

He accuses Alito of “inventive overreaching” when a judge because he dared apply the interstate commerce clause of the Constitution to **gasp** interstate commerce!

Alito doesn’t believe the Commerce Clause of the Constitution gives Congress broad power to control firearms. That’s why, in 1996, Alito was the only member of a 3rd U.S. Circuit Court of Appeals panel who would have let off an indicted gun dealer who had pleaded guilty to selling two machine guns on successive days at a Pennsylvania gun show in 1994. The plea was conditioned on the defendant’s right to challenge the constitutionality of the federal law.

On that appeal, Alito contended that the sale ? being intrastate, not interstate ? could not be reached by Congress through the Constitution.

Hello. Mothership to left wing moonbat. IT IS NOT INTERSTATE COMMERCE!

But how does he defend his opinion of Judge Alito? Why he cites more idiocy!

“Every court of appeals that has considered a challenge (to the provision) under the Commerce Clause has upheld the constitutionality of the provision.” - 3rd Circuit majority opinion

In other words truth be damned! If the court tomorrow said the sky was green and the grass was blue then by default it must be true!

The fact that you can go outside and clearly see that it is not means nothing to Hines. Ah, can you smell the elitism?

Likewise the fact that “interstate” commerce is defined as transactions of commerce between members of two states means nothing. And Judge Alito runs intellectual circles around the Judges that authored this decision and Hines who now cites it to promote an anti gun agenda:

Both statutes, departing from the mold of prior federal criminal statutes governing firearms possession, lack a jurisdictional element[fn7]. . . , that is, they do not require federal prosecutors to prove that the firearms were possessed in or affecting interstate commerce. Compare, e.g., 18 U.S.C. Section(s) 922(d). And in passing both statutes, Congress made no findings regarding the link between the intrastate activity regulated by these laws and interstate commerce.

See Mr. Hines it’s the Constitution that really matters and it CLEARLY says

A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.

I repeat

shall not be infringed

What is so damned hard to understand about

shall not be infringed

Nothing! It does not say

But alas like the intellectual lightweight that Himes is he never actually address the substance of the situation but instead talks about what he and others think things should be like. Too bad that such arguments are moot.

And not to be outdone he also throws in his typical rant against anyone that won’t accept it as gospel that women have an unfettered right to murder their children in the womb as well warning women

So, all you women who want to be ordered about like the kids, sit down right now and urge your senator to get aboard the Alito bandwagon.

Of course like a good little lefty trying to defend abortion he doesn’t tell you that the constitution protects the right of that child’s life either.

Of course if they could actually cite the Constitution and not fallacious judicial fiats to back up their positions people like Mr. Himes wouldn’t be liberal moonbats after all. And thank God for them because they are helping America move more and more to what they call the “right” each and every day. After all even a 10 year old has a greater grasp of the Constitution than they do. At least until the liberals start lying to them about what actually is and is not in it!
