Senator Jim Bunning on Fox News Sunday was discussing how he believed that Congress had to do something concerning Major League Baseball and steroid use. He talked about how Congress has to do this for “the children”.

Awwwww.

There’s a problem however. The problem is that there is NO Constitutional authority for Congress to do any such thing.

Senator Bunning is a Republican, and it just goes to show us all that “Republican” and “Constitutional Scholar” or even “Conservative” don’t go hand in hand.

And I’ll make the same challenge now that I have made a hundred times before. Anyone want to try and show me where in the Constitution is the authority for Congress to deal with steroid use in Major League Baseball or, for that matter, any other sport or private institution?

I am waiting.

My email to Senator Bunning:

I watched your appearance on Fox News Sunday and listened to you speak about the problems of steroid use and even steroid abuse in Major League Baseball. You also spoke about how it is Congress’ responsibility to handle this issue for the sake of our children and because Major League Baseball may not.

I ask this of you Senator, where in our Constitution which you are sworn to uphold do you find the authority for Congress to regulate a private enterprise or to dictate the policies of such an institution? Please Senator, I ask you to lay your finger upon the exact clause of that document from which you believe that this power you seek arises!

I dare say that you cannot truthfully find such a clause or such a power within your grasp.
