This statement was made while he also admitted “not all our decisions are right”.
Well NO FREAKING DUH! With an attitude like this, where looking at foreign law is a viable way to determine United States precedence, no wonder you are not always “right”! If you would spend more time simply doing what the Constitution says instead of trying so desperately to expand it by citing foreign law or creating law out of thin air I dare say that your rate of being “right” would go up dramatically!
It’s right there in Article III, Section 2 Justice Breyer! “The judicial Power shall extend to all Cases, in Law and Equity, arising under this Constitution, the Laws of the United States, and Treaties made, or which shall be made, under their Authority;” Got it? GOOD!
So stop with the “foreign law” bull. You are to look at what the Constitution of these United States says is law, not what some bureaucrat in France, Rwanda or India says!
