Congress Is Sticking Its Ding-Dong Where It Doesn’t Belong … AGAIN!
Congress is proposing to do something it does not have the authority to do. It is trying to regulate the private industries of Major League Sports and dictate to these leagues how they WILL test for substance abuse “or else”.
Substance abuse is bad. I don’t like it. And I personally think that it cheapens the performance of athletes in the leagues. But we already have a ton of laws on the books to punish people that use controlled substances be they right, wrong or indifferent. H.R.2565 and S.1114 have been introduced into the House and Senate respectively and are affectionately titled the “Clean Sports Act of 2005″. Aw … how cute and how fuzzy. I guess every usurpation of Constitutional power needs such a cute and inspiring name like this in order to draw support.
What it should really be called is the “Congress Adds More Powers to Itself Not Found In The Constitution Act of 2005″. Of course, 95% of everything that Congress passes into law would fit into that category these days.
Yes, the Bill sounds nice and yes, it is going to get a lot of support because it strives to do something many people want to have done and that is prevent drug use. But there is a problem. And as previously stated, that problem is that it is Unconstitutional.
Article I, Section. 8 of our Constitution grants Congress the following powers:
The Congress shall have Power To lay and collect Taxes, Duties, Imposts and Excises, to pay the Debts and provide for the common Defense and general Welfare of the United States; but all Duties, Imposts and Excises shall be uniform throughout the United States;
To borrow Money on the credit of the United States;
To regulate Commerce with foreign Nations, and among the several States, and with the Indian Tribes;
To establish an uniform Rule of Naturalization, and uniform Laws on the subject of Bankruptcies throughout the United States;
To coin Money, regulate the Value thereof, and of foreign Coin, and fix the Standard of Weights and Measures;
To provide for the Punishment of counterfeiting the Securities and current Coin of the United States;
To establish Post Offices and post Roads;
To promote the Progress of Science and useful Arts, by securing for limited Times to Authors and Inventors the exclusive Right to their respective Writings and Discoveries;
To constitute Tribunals inferior to the supreme Court;
To define and punish Piracies and Felonies committed on the high Seas, and Offenses against the Law of Nations;
To declare War, grant Letters of Marquee and Reprisal, and make Rules concerning Captures on Land and Water;
To raise and support Armies, but no Appropriation of Money to that Use shall be for a longer Term than two Years;
To provide and maintain a Navy;
To make Rules for the Government and Regulation of the land and naval Forces;
To provide for calling forth the Militia to execute the Laws of the Union, suppress Insurrections and repel Invasions;
To provide for organizing, arming, and disciplining, the Militia, and for governing such Part of them as may be employed in the Service of the United States, reserving to the States respectively, the Appointment of the Officers, and the Authority of training the Militia according to the discipline prescribed by Congress;
To exercise exclusive Legislation in all Cases whatsoever, over such District (not exceeding ten Miles square) as may, by Cession of particular States, and the Acceptance of Congress, become the Seat of the Government of the United States, and to exercise like Authority over all Places purchased by the Consent of the Legislature of the State in which the Same shall be, for the Erection of Forts, Magazines, Arsenals, dock-Yards, and other needful Buildings;–And
To make all Laws which shall be necessary and proper for carrying into Execution the foregoing Powers, and all other Powers vested by this Constitution in the Government of the United States, or in any Department or Officer thereof.
I know I harp on it A LOT, but “promote the general Welfare” does not mean that government has the right to do anything they want. In fact James Madison who was a principle architect of our Constitution said of the general Welfare clause in Federalist #41 the following:
It has been urged and echoed, that the power “to lay and collect taxes, duties, imposts, and excises, to pay the debts, and provide for the common defense and general welfare of the United States,” amounts to an unlimited commission to exercise every power which may be alleged to be necessary for the common defense or general welfare. No stronger proof could be given of the distress under which these writers labor for objections, than their stooping to such a misconstruction.Had no other enumeration or definition of the powers of the Congress been found in the Constitution, than the general expressions just cited, the authors of the objection might have had some color for it; though it would have been difficult to find a reason for so awkward a form of describing an authority to legislate in all possible cases. A power to destroy the freedom of the press, the trial by jury, or even to regulate the course of descents, or the forms of conveyances, must be very singularly expressed by the terms “to raise money for the general welfare.”
But what color can the objection have, when a specification of the objects alluded to by these general terms immediately follows, and is not even separated by a longer pause than a semicolon? If the different parts of the same instrument ought to be so expounded, as to give meaning to every part which will bear it, shall one part of the same sentence be excluded altogether from a share in the meaning; and shall the more doubtful and indefinite terms be retained in their full extent, and the clear and precise expressions be denied any signification whatsoever? For what purpose could the enumeration of particular powers be inserted, if these and all others were meant to be included in the preceding general power? Nothing is more natural nor common than first to use a general phrase, and then to explain and qualify it by a recital of particulars. But the idea of an enumeration of particulars which neither explain nor qualify the general meaning, and can have no other effect than to confound and mislead, is an absurdity, which, as we are reduced to the dilemma of charging either on the authors of the objection or on the authors of the Constitution, we must take the liberty of supposing, had not its origin with the latter.
See that? Madison himself said that the powers of Congress included in what is meant by “general Welfare” immediately came after this statement.
So what were they again?

So why does Congress think for one second that they could get away with this unconstitutional act? The answer is because for the most part the people of this country are ignorant as to what the Constitution says and what those words mean. And they are ignorant because the government run schools keep them that way … and they like it that way. Anyone truly remember leaning about Federalist #41 in school when they were teaching you about the Constitution and what the Founders gave us? I didn’t think so.
And it isn’t going to change any time soon because the status quo of ignorant Americans means those in Congress can keep doing unconstitutional things and it means they can get more power for themselves.
Christians Standing Up For Themselves!
Kyle Trudelle is the latest Christian to be persecuted for daring to imply that yes, there is indeed a God. Kyle’s work on a mural at his school in Napa California has drawn the ire of anti-religious zealots that fear anything that smacks of religion or acknowledgement of a Creator.
The mural was originally to contain a picture of a stairway leading to a castle in the clouds with no overtly religious symbols such as the Christian Cross, the Jewish Star of David or the Islamic Cressent. But that was too much for a pair of his critic that started petition to stop the painting. One can only assume that they are atheists since the religious symbolism was so vague that no particular religious group could complain. And we all know how Atheists burn and seethe at any possible mention of “God” right?
It is either that or some incredibly misguided religious folk that fear any religion being mentioned other than theirs. But I?ll place my bets with them being Atheists.
Well too bad! And Kyel Trudelle is fighting back with the help of powerful legal council that actually understands what the first amendment says and means.
Here’s a question to all you Atheists out there attempting to remove religion from our lives. Are you going after our founding documents next? Because there is quite a bit of religion in them!

The Difference Between Bernie Sanders And An American

Sounds nice doesn’t it? Problem is, he forgot to add something very important to that statement and that is he thinks that everyone else should pay for your “health care”, your “union” benefits, and to send “your child to college” under threat of reprisal from the government if they decline to do so. And what exactly he means by “good air” is anyone’s guess since air, even in so called “pristine” areas is often times drity with particulate from dirt and many other contaminants as well. So we’ll just chalk that “good air” comment up to Mr. Sanders knowing how to throw in a good buzz word every now and again. No one, not even those EVIL corporation owners are for having air that is not “good” because they have to breathe it too.
The difference between Mr. Sanders and an American is that an American believes that you should pay for your own “health care”, “union”, and “college” and even have the right to ask other people to voluntarily help you out with those things if they want to. But an American doesn’t believe that anyone should be forced to provide you with any of the above things or be thrown in jail or shot.
Bernie Sanders is vying for the Senate seat currently held by fellow lefty Jim Jeffords who used to try and pretend to be a Republican but gave up that charade several years ago. And if Mr. Sanders wins, it would be like putting a new tire on the car … you wont notice any difference. Except that Mr. Sanders admits what he is and Mr. Jeffords still pretends to be an American.

++ Myth #2–Illegals come to the U.S. for jobs to support their
families back in their homeland.
This is partly true. However record numbers of those illegally
crossing the borders are women and children! What’s more, there
are also record numbers of dead-beat dads who simply abandon
their families.
++ Myth #3–Illegals don’t affect politics because they can’t vote
Not true. The fact that they are counted in the census gives them
political power. Since representatives in Congress are fixed, it
creates a situation in state’s that have a heavy influence of illegals.
Those “illegals” will likely be represented. As such, it takes away
representation from people in other states–people who are here
legally.
++ Myth #4–Illegals do the work that Americans won’t do
Not true. Americans will do the work provided they are paid a
reasonable wage. But profit-greedy employers and corporations
are increasingly favoring cheap labor. Their profits soar, but at the
expense of American taxpayers who have to subsidize the labor
costs by supplying the illegal workforce (and their families) with
welfare, education, medical, housing assistance. Employers of
these people simply turn a deaf ear.
++ Myth #5–Illegal Immigration doesn’t really affect me
Not true. As we have reported in the past, in non-border states like
Connecticut, North Carolina, Georgia and New Jersey, illegal
immigration is rampant. That means in each of these states,
benefits allocated to citizens are being taxed and stressed by
illegal infiltration. If the problem becomes severe enough (as in
California and Arizona) those services dry up. In both L.A., and
Tucson, AZ hospitals have been forced to close due to the
incredible strain of illegals.

Do They Even Teach The Constitution In School Anymore?!?
I guess they don’t! Mayor Jason West of New Paltz, N.Y. is set to be tried for violating the State’s laws on marriage and marrying homosexual couples without a license reports FOX News.
First, I will make it perfectly clear that I do not think the State should be involved in the process of marriage to begin with since the institution is religious. I say if two gay men want to get married and officially do the bone dance with Mr. Sphincter then let them join a church that allows it and be married in that church.
However what does get my goat is how homosexuals try to imply that they have a “Constitutional right” to be married. No, I am sorry to say, you do not. Again this goes back to my belief that the state should have no say in who is and who is not “married” legally.
You have Mayor West’s attorney who should be smarter than he appears spouting this tripe:
Mayor West stood up for the constitutional rights of people being treated unfairly and unconstitutionally,” said West’s attorney, E. Joshua Rosenkranz. “If he is wrong about that judgment, of course he will stand trial and we’ll pay whatever penalty and he’s prepared to do so.”
Ok Mr. Rosenkranz, a shiny new nickel to you if you can show me where in the Constitution you have a “right” to be married. I’ll even give you that nickel if you can show me where in ANY of the writings of the founding fathers who signed that document they mentioned “homosexual marriage” as a right that could be losely infered to exist under Amendment IX.
Mr. Rosenkranz, I hope that since you claim to understand the Constitution oh so well that you can explain how on Earth a “right” mentioned nowhere is a “right”!
Please also take note that Amendment X clearly says that “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.” Now, since the power to determine who is and who is not able to marry is not in the Constitution as being delegated to the federal government what does that mean?

Here’s a hint: It means that the States have the RIGHT to determine things such as marriage laws even if they shouldn’t establish them in the first place. And THAT is exactly what the State of New York did in this case.
It said “no” to homosexual marriage. So please Mr. Rosenkranz and all the rest of you lefties out there please stop it with the “marriage is a right” argument. It isn’t. And the States have the authority to determine these issues through their legislative bodies … again, even if they shouldn’t be.
Anti Christian Litigation Unit Strikes AGAIN!
Keystone School District in Knox, PA was prohibited from reciting a prayer at their graduation cerimonies because “someone” complained (KDKA News). Enter the ACLU better known as the Anti Christian Litigation Unit or also the American Communist & Liberal Union who, in the style of the former communist Soviet Union are rushing around attempting to ban religion from public life.
That’s right. One “someone” complained and the whole prayer thing is out … we can’t after all offend someone right? But when other residents are offended at this person’s actions causing them to not be allowed to freely practice their religion … well that is another story. Their “offense” at someone being “offended” doesn’t count because it doesn’t further the goal of wiping religion from the pubic square.
“Vic” Walczak, legal director of the ACLU’s Pittsburgh chapter (read un-American blood sucking pinko-commie sympathizer) said “When public schools reserve time at a graduation ceremony for prayers, they violate the Constitution by putting the power, prestige and endorsement of the state behind whatever prayer is offered.” (The Times Online)
Ok, time for a history lesson here on the Constitution since apparently Mr. Walczak thinks we are too stupid to read the Constitution and that he is somehow the great and powerful arbiter of what it says along with the ACLU.
Amendment I: Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise [of religion]
That means, that if someone wants to stand up at a graduation ceremony there can be NO LAW that prohibits them from freely practicing their religion. Now, since the courts don’t make laws (or at least they are not supposed to), the ACLU CANNOT go to court and sue to stop someone from praying at a public school because there can be NO LAW for which the court could find the defendant guilty of violating.
Oh, and just in case you forgot, since the ACLU will never tell you this either, there is a later amendment that makes it UNCONSTITUTIONAL for the States to violate your federal rights as well.
Amendment XIV: No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States…

Tax Payer Dollars Going Over Seas
On Thursday, President Bush pledged $50 million dollars in aide to Abbas and the Palestinians for new housing and other assorted projects in Gaza. According to ReliefWeb, the funds will be used to “improve the quality of life of the Palestinians living in Gaza where poverty and unemployment are very high.”
I guess the question is why is there high poverty and unemployment, and how does President Bush justify forced charity of the American people under threat of the government’s guns?
Throughout the years, the radical elements among Palestinians have been waging war with Israel and for many years under Arafat’s rein the Palestinians protected those radical elements. So Israel fought back, often times leveling entire neighbors to get at those that were being protected. If only some other leaders would be so forceful maybe we wouldn’t be where we are today with radical Muslim terrorists fighting representative governments around the world.
For the most part, I do not believe that the majority of Palestinians ever had any problems with Israel. But when you live in a controlled police state run by terrorists sometimes you are left with little choice, some would argue. I say you always have a choice.
The Palestinians have a long way to go in rebuilding trust after years of guerilla warfare against Israel. And more importantly federal dollars that could be used here at home to improve roads and infrastructure is being sent over seas against the roles of the power granted to the Federal Government by the Constitution. There are plenty of relief organizations that operate on voluntary contributions that should be filling this role and President Bush should NOT be promising this money and our resources.
When the Tsunami struck Southeast Asia I had no problem with the federal government sending truly “emergency” aid to those people affected. Sending an Air Craft Carrier to provide fresh water was fine because that was a crisis and people’s lives were at stake from an act of God and only the Federal Government had the resources and the power to act that quickly and with the required manpower. But for the Palestinians, their situation is largely due to their own actions. And they should be taken care of with a plea to both United States and international aid agencies and not money which we are forced to pay the government each year at the end of the barrel of the government’s guns.
There’s NO Crying in Politics!
Ohio Senator George Voinovich showed his girlie man side as he was fighting back tears during a limp wristed plea for people to vote against the nomination of John Bolton as Ambassador to the UN.
Voinovich, who admittedly missed most of the hearings on Mr. Bolton and then began reciting Liberal talking points about how bad his appointment would be said “I know, some of my friends say, ‘Let it go, George. It’s going to work out.’” and then rambled on between his failing voice “I don’t want to take the risk. I came back here and ran for a second term because I’m worried about my kids and my grandchildren. And I just hope my colleagues will take the time and . . . do some serious thinking about whether or not we should send John Bolton to the United Nations.” (source of quote Clevland Plain Dealer)
If only Voinovich would get this impassioned about say, the oppressive amount of Socialism that our government heaps upon us! My God! Maybe we’d get some REAL issue taken care of!
But no, instead, Voinovich is worried that Mr. Bolton’s curt and forceful personality will anger the dictator infested United Nations? GIVE ME A BREAK!
I wonder if this breakdown on the floor of the Senate has deeper roots. Has Mr. Voinovich been taking money from the Oil for Food scandal perhaps? I have to speculate because there really is no legitimate reason for this emotional outbreak over sending a man who has been accused of everything under the sun without much beyond hearsay evidence to a position he is highly qualified to hold.
